Erin Kennedy has more than 30 years of experience in the field of bankruptcy. During that time, she has helped individuals and businesses solve their financial difficulties and find a way to move forward with their lives. Small and mid-sized businesses and their owners have relied on her guidance for reorganization or, when necessary, liquidation.
Ms. Kennedy is well known for her experience representing both debtors and creditors in the bankruptcy arena. She has considerable experience in cases with complex lien and title issues, matrimonial issues, tax problems. She frequently handles litigation in the bankruptcy courts to resolve these and other disputes. She is experienced in motion practice to protect creditor rights in pending cases.
Creditors and panel trustees frequently retain Ms. Kennedy to represent their interests because of her skills in identifying valuable claims and assets and her ability to recover and liquidate them effectively. Ms. Kennedy has recovered millions of dollars from individuals seeking to fraudulently conceal them from the court and creditors.
She has helped owners of properties subject to liens and judgments to obtain clear title or sell the property free and clear of liens. Small business owners rely on Ms. Kennedy’s skills to guide them in dealing with equipment liens, business loans and protecting personal property.
Ms. Kennedy has handled appeals before the Third Circuit, where she successfully argued that the court should reject the accrual test in determining when an equitable distribution claim can be asserted against a spouse who files for bankruptcy while a divorce proceeding is pending. In re Ruitenberg, 745 F. 3d 647 (3d Cir. 2014).
Ms. Kennedy maintains an office in Rochelle Park, New Jersey. She has had a second home in Vermont since 2003 and was admitted to the Vermont bar in 2019.
